Terms and Conditions ~ Deed Poll

 

 

Confidentiality

Any information that you provide is solely for the use of Alpha Deed. The information always remains strictly confidential and is not provided or sold to any third party. 

Legal

Our document is official and of a standard legal format. It is valid in England, Scotland and Wales.  The Deed poll purchased requires two independent witnesses to sign it in order for it to become legally binding.  Usage of the Alpha Deed website does not in anyway comprise a consultation of a solicitor and therefore holds no liability for any such loss or damage resulting from the failure to adhere to this when using our documents.

Alpha Deed holds no responsibility for the accuracy of information contained throughout  this website.  Every effort however has been made to ensure the details are correct.

Our Guarantee 

Alpha Deed can guarantee a full refund if any Deed Poll issued by us is not accepted as documentary evidence of a name change by any UK company or governing department such as the DVLA or UK Passport Office.  A refund will be issued after 28 days. However, before we will issue a refund we will need to verify the non-acceptance with the company that is refusing to accept the Deed Poll.   We hope that this will guarantee that our Deed Polls are legally binding and as valid as those purchased through a solicitor.  This is the limit of our liability.

 Your right to cancel

EU Consumer Protection (Distance Selling) Regulations 2000 allow you to cancel your application within seven working days of submitting it.  However, to meet with our guaranteed timeframe we may commence work on your Deed Poll and pack within this time.  Therefore, we regret that your right to cancel is limited to the time between submitting your application to us and the time that we start to prepare your Deed Poll document.  Therefore we can only cancel and refund your application if you notify us before work commences on the preparation of your Deed Poll.  Once you have submitted an order for a Deed Poll pack  you are therefore agreeing  to waive your rights to cancellation as detailed in the regulations detailed previously in this paragraph.  This is the limit of our liability.

 Agreement of Terms and conditions

Alpha Deed does not provide any form of legal advice and bears no responsibility as to whether the purchased document is an accurate representation of your individual needs.   It is the full responsibility of the purchaser to ensure that the Deed poll is correctly signed and witnessed in order for it to become legally binding.  Alpha Deed holds no responsibility for a Deed poll being classified as void resulting directly from the incorrect signing and witnessing of the document by the purchaser.  

Postage of your document

Your Deed Poll document will be sent to you within 2-3 working days after payment has been received.  (If paying by cheque please allow an additional 5 days to allow cheques to clear).   All documents are sent out by first class mail.   If you have not received your Deed Poll document within seven days from receipt of your cleared funds, upon such notification, Alpha Deed will reissue your Deed Poll pack free of charge and within 24 hours. This is the limit of our liability.   Postage and packing is included within the price of your document. 

(Should Royal Mail experience any industrial action resulting in severe delay to the normal levels of service, all of the above conditions will be deemed as void.)

Payment

Before we start to prepare your Deed Poll document we will require the correct payment in full.  We accept all major credit/debit cards and cheques or postal orders made payable to Alpha Deed.  Credit/debit payments are processed through Worldpay, our secure online service provider.  Processing of your Deed Poll will only commence once authorization for your credit/debit card is received from Worldpay.  If you are paying by cheque, this will need to have cleared before we start to prepare your Deed Poll.

 The right to refuse

Alpha Deed has the right to decline an application without stating a reason to the applicant. Monies will automatically be refunded in full.

Alpha Deed has the right to refuse any application deemed to be inappropriate thus containing any offensive or rude words.  If payment has already been made then monies will automatically be refunded in full.

 If a mistake is made by Alpha Deed

If any spelling mistake or typing error is found on your Deed Poll document we will agree to reissue your Deed Poll within twenty four hours of such notification being received by ourselves.  Once a Deed Poll document has been signed, your rights to a refund are automatically waived as you are therefore deemed to have accepted it.  We will not accept any requests for a refund or replacement Deed Poll if the notification is received after 28 days after receiving your Document.

 If a mistake is made by the customer

If incorrect information is supplied to us on your application form (online or by post) e.g.: incorrect spelling of a name or incorrect spelling of address details etc, we will agree to issue a replacement Deed Poll for the fee of £10 within 3 working days.  Please note:  Names and addresses will appear on your Deed Poll as they are spelt on your application form.   Any names incorrectly spelt on an application form therefore resulting in an inaccurate Deed Poll will incur the £10 fee for a replacement Deed Poll.  With regards to a child Deed Poll, if the mother was not married to the father at the time of the child�s birth then the father does not need to appear on the Deed Poll.  If the applicant states the fathers name on the application form then his name will appear on the Deed Poll.  If the father cannot sign the Deed as his whereabouts is no longer known and the mother then requests a replacement document stating her name only, a fee of £10 will be charged to cover administration costs.  This is the limit of our liability.

 Responsibility of the customer

Alpha Deed would like to make the customer aware that it is their responsibility to have the necessary letters of consent required to make the Deed Poll legally binding.  Without these letters you risk invalidating your Deed Poll. Alpha Deed does not need these letters to be submitted along with the application form.

Alpha Deed would also like to make the customer aware that it is their responsibility for the correct completion of the Deed poll application form.  We cannot be held responsible for an incorrect Deed poll due to an error made by the customer.  Customers will not be entitled to a refund if they have provided incorrect information at the time of application.
